Question by David C: Court Question about underage drinking?
I visited my friend at university of delaware and I drank too much and went to the hospital. I was charged with underage consumption of alcohol. He took a breathalyzer and there is no way I am not guilty, but I am told to plea guilty because I can get probation before judgement. I do not have a criminal record but if I plea not guilty and get probation before judgement does that mean I do not have to go court again. Plus if I plea not guilty that will not insult the judge or cop.

Answer by El Jefe Short answer…if you are charged with any crime more serious than a speeding ticket, get a lawyer.
You will always be pressured to plead guilty…even if you are not guilty! Depending on your circumstances, if you are guilty then a plea might be your best bet…or you might be better off going to trial, even if you are G-U-I-L-T-Y guilty.

A Delaware man accused of fabricating a perfect record of academic achievement to get into Harvard University has been ordered held on $ 5,000 bail after pleading not guilty Tuesday at his arraignment.
If Adam Wheeler makes bail, he must stay away from Harvard and the other academic institutions involved in the alleged scheme, surrender his passport and remain in Massachusetts, a Middlesex Superior Court judge said.
The 23-year-old Wheeler of Milton, Del., is facing 20 counts of larceny, identity fraud and other charges.
Wheeler claimed he got a perfect score on the SAT, straight A’s at prestigious prep school Phillips Academy Andover and at the Massachusetts Institute of Technology on his application to Harvard in 2007, prosecutors said. In reality, he had never attended either school, Middlesex District Attorney Gerry Leone said.

Question by OchoCinco: Need advice in Delaware law for underage possession of alcohol!! Please?
I was recently stopped by a Newark police department cop who saw me walking with an open bottle of beer in my hand. I was written a citation for underage possession of alcohol and given a court summons date. I was told the fine would be for about $ 200 and I would have a criminal record. I have no problem paying the fine but do not want to have a criminal record as it could hurt with job possibilities in the future. Should I attempt to fight this case? Will pleading not guilty get me off the hook if the cop is a no show on my summons date? What are Delaware consequences for first time offenders charged with underage possession of alcohol? Is there anyway I can get this criminal record removed or expunged? And if not, will it ever disappear? please not that i am also 18

Answer by OldJimmy Pleading not guilty, cop present or not, will only cause them to set a date for trial. Only do that if you were not carrying the bottle and have evidence of that, or evidence of some misdeed by the cop.
Talk to the prosecutor in your case before your hearing. Ask them if they have some sort of deferred adjudication or diversion program you could agree to, to avoid a record. You would pay fines and court costs, but if you complete the process with no other violations (of any kind) the charges get dismissed as if they never happened.
They don’t have any interest in tagging people with records, and if you’re willing to pay the costs and go through the program they can get this one off their calendar quickly so they have time to prosecute the idiots who plead not guilty.
