Someone claiming a false court claim on me?

I live in South Carolina. I have a cousin up in New Jersey, which I have not been there in years. My cousin filed a false report to the courts about me afew weeks ago. Last monday on the 23rd of May, I got a letter from the courts in New Jersey saying that I must come to court up there next month because im being charged for harrassment. First thing is that I have not talked to him in over a year. I never emailed him either. On the report he stated that I sent him harrassing emails, then that I been calling his phone saying ” your days are numbered” , and the bad thing is that I dont even have his phone number. So the few questions I have is : How can someone from another state get someone introuble in another state ? How can the courts say that I must appear in court up there with no evidence ? If i was to file a complaint about him, I cant do it from the state I live in. I talked to the sherrif here, the courts, and they told me that I must go up there to file a complaint . How can he do it to me and I cant do it to him when he is sending me harrassing emails, and I have them saved ? Also IF I could not make it to court up there, there will be a warrent for my arrest.. How can they do all this ? First of all, my social security number isnt published there, neither is my drivers license . Could I just tell the courts by calling them up there and say that there is no niko here ? My name on my records are nicholas. Could I just say that there was a niko here with the same last name who was just a roomate I met online afew years back and get away with what I want to say ? I did also understand that if I didnt show up in court that there would be a warrent for my arrest, and the only time i would get arrested is IF they wanted to extradite me. So this means that even if I got pulled over, i would not have anything to worry about ?? I dont have money for an autorney, or to drive up there…. Can someone help ??
Larry,, No it doesnt state he has proof. I have proof on my phone records that I never called him.

Well, it seems live you have to go up there. If you want to you can file a complaing and sue the person for harrasment. Brng all you evidence, e-mail,phone messeges ect. Get a… cant remember the name, the think where he cannot contackt you. And if you feel like it try to take some money too. You should probaly talk to a lawyr.

Question by : Is it possible to be off probabtion without paying fines?
Basic situation: my fiancè had an assault charge in the state of Montana about 4 or 5 years ago and has been off probabtion for 3+ years. During this time he had his license expire and revoked (due to driving too fast). He called the dmv about six months ago to find out what he needed to do and they said just he needed to pay a reinstatement fee and retest. He called yesterday to get the address to send the money into and they said there was a hold on it due to a 500 fee on the assault charge not paid off. My fiancè is positive he paid it off…one of the stipulations to getting of probation was paying it off for one and he remembers finishing it.

Assuming he doesn’t remember correctly is there anyway that could have even happened?? And what should we try to find out to show he paid it? Can you request back court records?

We’re confused because we know he’s off probation and we know he had to pay all court fines before getting off probation… so what on earth?

He should call his old probation officer and ask him to fax/email his paperwork that says he paid his fines. Then he can show that to the DMV.

Anyone else getting sick of it? I also found some info on the history of this ministry. The ministry has been accused of preying on the very low income and the elderly by using census records to target their mailings. Initial mailings often only speak of the “power of prayer”; once a recipient responds and is placed on the church mailing list, they are targeted with letters saying that monetary donations are required for their prayers to be answered. Although for several years the ministry operated without a church building and conducted its direct mail donation operation through the Tulsa address, a physical location to hold services — a then-78-year-old Baptist church in a predominantly Hispanic neighborhood — was purchased in Houston in 2004. St. Matthew’s Churches’ lawyer says weekly services draw about 1000 people. According to the Trinity Foundation, an evangelical watchdog group, the physical churches are only associated with the mail-based ministry as a cover that allows the lucrative operation to retain tax-exempt church status. The status was granted by the Internal Revenue Service in 2000 after a 17-year court battle. One of their mailings consisted of a paper “prayer rug”, on which recipients were encouraged to kneel and pray. This mailing, along with others, have been mentioned by the Attorney General of the State of Arkansas, among others, as not providing information about their financial and fundraising practices. In 2008 i got into a motorcycle-car collision *i was on the motorcycle* the accident happened on an uncontrolled intersection i was west bound coming to the intersection and the guy i recked into was north bound, neither of us seen each other because of a very large tree obstruction on the side of a mans yard. As law has it in my state *WYOMING* If 2 people come to meet at an uncontrolled intersection the person to the right of you has the right of was and the person to the left must stop.

well the guy i hit was speeding about 20 miles over the speed limit, i got to the intersection, as he got to the intersection and his vehicle speeds right in front of me and i end up T-boning the car. The man gets out of his vehicle, pulls me out from under my bike and call the police *i suffered little to no damage by use of Motorcyclist saftey equipment. My motorcycle suffered damage to the engine, damage to the body and damage to the frame. The car suffered MAJOR passenger side damage.

The cop finally shows up after bout 30 minutes of waiting, and starts to take our insurance information, and all the other info. Well come to find out the guy wzas driving on a suspended lisence, expired tags, and no valid proof of insurance. I had my VALID drivers lisence, my VALID tags but at the time i did not have teh right insurance form. as the cop is writing a ticket for me for no insurance my buddy pulls up, gives me the insurance paperwork and teh cop stops fillign teh ticket out, and tells me *here take this as a reminder to always have your needed paperwork on your vehicle* he issues the out of state man who has no valid lisence, insurance or tags his ticket. a few days later my insurance company calls me and asks for my info. then they ask me to bring my info in so they can make a copy of it. about a month later i get paper work in the mail saying that i didn’t have any insurance during the time of the accident and i had to PAY for the damage to the mans car *which he shouldn’t have been on the road at all in the first place.*

I call and try to contact the guy to get his insurance info as well as my number *i had lost my insurance paperwork in the laundry along with all the other paperwork in my wallet.* the gu never answers his phone, never answers his mail so i had that to pass the liability, but then the WYDOT *wyoming department of transportation* says i had no insurance during the time of the accident. i then go back to my insurance company, and i find that the man CANCELED my insurance when i brought the paper work into him to he could “copy” it. the man was relocated not long after i brought my paper work in and they said they couldn’t give me his contact info.

The WYDOT then tells me that i have to hold a sr-22 for 3 years if i want my license. I was told my an old Supreme court buddy of mine that all i had to do to avoid the sr-22 was to wait a year with no license and i would have my driving privileges reinstated. well a year passes since my license expired and then WYDOT tells me i still have to carry the sr-22 for 3 years…

Now i know if i didn’t have insurance i would have gotten a ticket. If anyone looks at my record i have absolutely no tickets on my record, no violations, and no crimes. i called the officer that same year to find out what was going on and see if he could help me. the cop has no recognition of the accident, and says that he doesn’t remember my name or the case. *pretty messed up for a cop huh* so my question to you is, do i have legal rights to sue the state of wyoming for harassment or pain and suffering or something to get my license back with out the sr-22? all i want is my freaking license back but the state of wyoming or the cops of cheyenne are trying to play with me. please any legal help would be awesome.
For those who do not know, Wyoming has its own supreme court located in down town Cheyenne across from the hospital and the old supreme court building ;P

Your biggest problem is that any argument you may have, is pretty much negated by the fact that you waited for a year to fix it assuming that if you waited a year, it would all go away.

It’s not at all *pretty messed up for a cop huh* to not remember details of a minor accident a year ago, you really expect him to remember every accident over the course of a year?
