Federal authorities say the temp agency that supplied an East Stroudsburg factory with undocumented workers in 2007 is involved in an extensive and complicated web of fraud.

They say, in court papers, that H&T Staffing Services, operating under that and other, similar names in Pennsylvania, fraudulently raked in nearly $2.5 million in one year.

Pocono Record: Coverage of the Iridium Illegal Immigrant Raid People involved in the staffing company have been brought through United States Middle District Court of Pennsylvania ever since the June 2007 raid of Iridium Industries in East Stroudsburg.

During the raid at the plastic-container plant, 81 illegal immigrants were arrested by U.S. Immigration and Customs Enforcement. Iridium was not charged in connection with the raid.

The court is currently considering the case of Can Thach. Thach was indicted in September through a joint investigation by ICE, the U.S. Department of Labor, the U.S. Department of Health and Human Services and Pennsylvania State Police.

According to the indictment:

•Thach and others owned, managed and operated labor-leasing or temporary employment companies in Pennsylvania using the name H&T Staffing Services and variations of that name.
•H&T supplied workers to various companies, although Iridium Industries’ Artube division is the only business named in court papers. Iridium paid H&T for the workers provided, and then H&T paid themselves and the workers. At least some of the Iridium workers came through a Wilkes-Barre office of H&T.
•Thach and others cashed checks from Iridum and other companies at check-cashing businesses in Philadelphia. Workers were paid in cash, under the table.
•H&T filed false unemployment compensation and Internal Revenue Service forms to hide that the business employed illegal aliens. “This resulted in significant loss to both the Pennsylvania unemployment compensation fund and the United States Medicare Trust Fund,” the indictment said.
•Thach and others are accused of omitting the names of illegals on quarterly forms required by the Pennsylvania Unemployment Compensation Program. Instead, they used names of family members and friends who did not work for the business, in order to give the business the air of legitimacy, according to the indictment.

Through the unemployment scheme, H&T defrauded the program out of more than $100,000 in taxes, interests and penalties.

Five tax forms were sent to the IRS with false statements, claiming H&T had a small number of employees. The business failed to pay the required Medicare withholdings contributions for employees, resulting in $67,000 in loss to Medicare.

Thach will go on trial in December for conspiracy to commit money laundering and fraud, false statements related to health care matters and transporting illegal aliens.

H&T was more involved in workers’ lives than typical employment agencies. The company transported workers to and from the job. Using profits from the scheme, H&T purchased properties, at least one in Stroudsburg, then harbored illegals in some of the properties, charging them rent.

In November 2008, H&T Staffing owner Jimmy Nguyen pleaded guilty to conspiracy to commit money laundering and conspiracy to defraud state and local governments. Nguyen was sentenced to 70 months in prison. When he gets out, he must repay the nearly $214,000 he owed to the Pennsylvania Unemployment Compensation Program and $345,000 to the U.S. Medicare Trust Fund.

Sufini Alisaito, Hardy Ko and Hew Deng Kong pleaded guilty to conspiracy to transport illegal aliens in connection to the immigration raid. They were each sentenced to two years supervised release.

Details on the accused in the case are sparse because many of the documents are sealed.

BP attempts to break cycle of repeat crossings

U.S. Border Patrol agents in the Tucson Sector would like to see the day when fewer illegal immigrants travel north from Mexico to Arizona to seek work. Then agents could concentrate on apprehending dangerous criminals, said Rob Daniels, public affairs officer for the Tucson Sector.

Robert Gilbert, chief of the Tucson Sector, wants to “end voluntary departure as an option, to prevent them (immigrants) from coming back,” Daniels said.

About 90 percent of the people apprehended by the Border Patrol have no criminal record or warrants, Daniels said. They can avoid a formal deportation in federal court if they agree to be bused back to Mexico, a process called “voluntary departure.”

But now the Border Patrol is sending more immigrants to federal court in Tucson to face prosecution for the misdemeanor offense of entry without inspection.

“If they are prosecuted by a judge, then they have a record,” Daniels said. “They can’t come back legally for five years.”

The Border Patrol began apprehending more people in 2004, when the Arizona Border Control Initiative brought more agents and technology to states that border Mexico, said Gustavo Soto, supervisor for public affairs in the Tucson Sector. That initiative evolved into the Arizona Denial Prosecution Initiative, which selects a percentage of illegal immigrants for prosecution.

“What the chief wants is for you to face jail time,” Soto said. “If there’s no consequence to your crossing the border, you’re going to try again.”

Soto admitted it would bog down the federal court system if 100 percent of the immigrants were prosecuted. The Arizona Daily Star reported last April that prosecuting some 60 people each day put a strain on the federal court system, which had to bring in extra attorneys.

Since Arizona Denial began in January 2008, more than 9,500 individuals were prosecuted, said Mario Escalante from the Tucson Sector. The initiative focuses on a 15-mile stretch of border southwest of Tucson.

As well as Arizona Denial, the Border Patrol has these operations:

• Operation Streamline: More than 9,600 individuals with a criminal history or repeated illegal entries saw an immigration judge at the Tucson Sector office instead of going to federal court.

• Mexican Interior Repatriation Program: During the hottest months, the BP, Immigration and Customs Enforcement (ICE) and the Mexican Consulate screen immigrants who want to go home and put those eligible onto flights to the interior of Mexico. In summer 2008, more than 18,000 people returned to their home towns.

• Alien Transfer Exit Program: Between March and Sept. 30, 2008, more than 5,800 immigrants were bused to a port of entry far from the area where they were apprehended, said Escalante.

When immigrants are released through the Nogales ports of entry, often a smuggler is waiting for them in a van, Soto said. “Many of the men or women aren’t in any condition to go back out to the desert for two or three days.”

Instead, agents put the individuals on a bus to San Isidro or Calexico, Calif., to cross into Mexico, Soto said.

In fiscal year 2004, only 8 percent of illegal immigrants were removed by a means other than voluntary departure, Soto said. But in fiscal year 2008, 22 percent went through a court process or were flown to the interior or repatriated at a distant port.

“We want to get that figure to 100 percent,” Soto said. “If you cross through Arizona, you will face some kind of consequence. We don’t want anybody to cross through these hazardous deserts.”

But is this strategy working?

The number of illegal immigrants picked up by agents in the Tucson Sector declined to 317,696 in fiscal year 2008 ��“ Oct. 1, 2007-Sept. 30, 2008, Daniels said. This is lower than FY 2007,when 378,074 people were apprehended. In 2006, the figure was even higher ��“ 392,074.

Figures are not separated for the eight stations within the Tucson Sector, Soto said. They include people taken to BP stations in Ajo, Casa Grande, Douglas, Naco, Nogales, Sonoita, Tucson and Willcox.

“October, November and December are our slowest months of the year, Daniels said. “A lot of individuals are going south because of the holiday, or not coming north.”

Do u think illegals who are charged with felonies should be granted bail like here 2 illegals charged sexual assault of Austin woman ? Since they are in the country illegally and since they would be flight risks should bail even be offered ? Why no immigration detainer on them ?
Two brothers face felony charges stemming from an alleged sexual assault of a woman last week in Austin. A third brother also has been charged with an unrelated felony.

Oscar Barrera Sanchez, 27, and Pablo Barrera Sanchez, 24, each face a single felony count of third-degree criminal sexual conduct for allegedly forcing sexual intercourse early Wednesday with a 23-year-old woman at their Austin apartment, Mower District Court records show.

Oscar Sanchez allegedly first sexually assaulted the woman, and Pablo Sanchez sexually assaulted her immediately after him, according to a criminal complaint.

Pablo Sanchez, also known as Lorenzo Andrew Leal, also faces a felony count of aggravated forgery for allegedly using a false Minnesota ID card.

Their brother Jorge Barrera Sanchez, 18, also is charged with a single felony count of aggravated forgery for allegedly possessing a fake Minnesota ID card.

On Monday, the Sanchez brothers, who live in Unit 2 at 505 Fifth Ave. N.W., appeared in court.

Judge Fred Wellmann set bail for Pablo Sanchez and Oscar Sanchez at $250,000 each without conditions or $50,000 with conditions, including that they cooperate with federal immigration officials and be monitored by a global positioning system, court documents show.

Bail for Jorge Sanchez, also known as Joseph Bilal Donya Hooker, was set at $50,000 without conditions or $10,000 with conditions.

All three men are to return to court on Nov. 24.

What is your honest opinion on this illegals Deportation Records it took a fatal accident for police to take arresting him as a serious matter , why ?
FOX23 has obtained exclusive information about an illegal immigrant accused of hitting and killing an elderly woman.
It happened one moth ago as 74-year-old Beverly Duffield was riding her bike in West Tulsa.
In a Freedom of Information request and Roberto Alvelais-Torres consent this is the first time you’ll learn publicly Torres has been removed from the United States three times since 2006.
Public records show Torres run-ins with Tulsa Police started in 2003.
However, Immigration and Customs Enforcement (ICE) records known as Detention and Removal Operations (DRO) records show Torres’ run-in with Customs and Border Protection (CBP) officers started in 2006.
Now he’s accused of hitting and killing an elderly woman.
74-year-old bicyclist Beverly Duffield died along 17th and Southwest Boulevard last month.
Torres was arrested later that day. FOX23 discovered in 2003 Torres has been found guilty of a hit and run in Tulsa and a DUI but before he was punished he was nowhere to be found until is run-in with CBP officers.
ICE records show on January 20th, 2006, at the Dallas Ft. Worth International Airport CBP officers denied Torres entry into the U.S. Torres was then removed to Mexico.
On February 9th, 2006, near Laredo, Texas, Torres was arrested by CBP officers where his removal order was reinstated and he was sent back to Mexico.
On March 5, 2006 near Premont, Texas, Torres was busted again by CBP officers and this time he was he was going to face felony charges for re-entry.
However, records show he was previously convicted for re-entry without inspection, a misdemeanor. Torres was again removed to Mexico.
However, public records show on July 8, 2006, Torres made his way back into the U.S.
Tulsa Police officers caught up with him for his outstanding 2003 charges. No jail time but he paid a $745 fine
ICE says they have no record of Torres from March 2006 until this year.
Torres faces the law again accused of killing a woman with his car.
Torres is charged with Negligent Homicide and Leaving the Scene of an Accident.
Torres’ next court date is scheduled for October 9th. He is being held on $50,000 bond but Torres has an ICE Hold.
In the Freedom of Information request FOX23 also learned since September 2007, when the 287-(g) immigration law went into effect 1,133 illegal immigrants have been commercially removed from the Dallas Area of Responsibility-Oklahoma Sub-Office.

Why are Activists are complaining that the police should not be allowed to run a background check on illegals who have been arrested ? Four Central Florida counties are joining a growing list of law enforcement jails on a federal push to identify and deport illegal immigrants already behind bars, the Immigration and Customs Enforcement agency announced Monday.

Orange, Osceola, Polk and Volusia counties will join Lake in the “Secure Communities Initiative,” which gives jails access to combined FBI and Homeland Security databases of criminal and immigration violations. The arrangement comes through an agreement between ICE and the state and allows jails to submit fingerprint data for their inmates to be checked against federal records.

Activists are complaining about the partnerships, saying they don’t want Florida to enforce immigration offenses like Arizona, where a controversial new law making illegal immigration a state crime has stirred fears of racial profiling and civil-rights violations.

However, ICE officials said the program is a public-safety initiative and not just a dragnet.

“All of these individuals had to have been arrested for a criminal charge and have to be in jail,” said David Bradley, deputy director for ICE’s Office of Detention and Removal in Miami, which oversees enforcement throughout Florida. “It allows us to stop recidivist offenders” from being released.

ICE said 24 Florida counties, including Escambia, Leon, Palm Beach and Sarasota, and 20 states are participating. But immigrant activists are wary of any local effort to enforce federal immigration law and continue to call for national immigration reform that would balance enforcement with legalization.

The Florida Immigrant Coalition, a Miami organization that unites dozens of immigrant advocacy groups, hopes that Florida doesn’t follow Arizona’s path.

“The whole fiasco in Arizona started with one local county thinking it was OK to develop this unholy alliance with ICE and criminalizing its own people,” said Subhash Kateel, a community organizer. “The biggest problem is people are flagged for deportation at the point of arrest and not of conviction, and so they never get the benefit of being presumed innocent.”

ICE spokeswoman Nicole Navas said the county jails have found repeat offenders, including murderers and rapists, and have not targeted anyone not already slated for deportation.

“These are fingerprinting databases,” she said, “and it’s a colorblind system.”

My question is activists would rather see repeat offenders, including murderers and rapists set free and police must not check their finger prints as it would mean the police are trying to enforce federal immigration laws and the police are not properly trained on how to arrest somebody from Mexico.
