I was recently stopped by a Newark police department cop who saw me walking with an open bottle of beer in my hand. I was written a citation for underage possession of alcohol and given a court summons date. I was told the fine would be for about $ 200 and I would have a criminal record. I have no problem paying the fine but do not want to have a criminal record as it could hurt with job possibilities in the future. Should I attempt to fight this case? Will pleading not guilty get me off the hook if the cop is a no show on my summons date? What are Delaware consequences for first time offenders charged with underage possession of alcohol? Is there anyway I can get this criminal record removed or expunged? And if not, will it ever disappear? please not that i am also 18

Pleading not guilty, cop present or not, will only cause them to set a date for trial. Only do that if you were not carrying the bottle and have evidence of that, or evidence of some misdeed by the cop.

Talk to the prosecutor in your case before your hearing. Ask them if they have some sort of deferred adjudication or diversion program you could agree to, to avoid a record. You would pay fines and court costs, but if you complete the process with no other violations (of any kind) the charges get dismissed as if they never happened.

They don’t have any interest in tagging people with records, and if you’re willing to pay the costs and go through the program they can get this one off their calendar quickly so they have time to prosecute the idiots who plead not guilty.

Question by LA DAILY: I need to get something expunged from my record that happened in Wyoming 9 years ago HOW????!!!?
I have a case that just popped up on my records after 9 years- I thought was over, I was never convicted in Wyoming but somehow on my record is says that I was and that I plead guilty…which I never did…. ( I never went to court in Wyoming or had a court order to appear) I spoke with one case manager and he told me that It will cost me 2500 dollars to handle this case. Does that sound right? Where do I start with this?

might…but why not start with a call to the county clerk’s office where the thing is on record and see if they can just fix it?

Need legal advice for TN- I think I may have a warrant for my arrest? what should I do?

Here’s (briefly) my story:
In 2007 I was pulled over and my car searched. Officer found a pipe. I was charged with a misdemeanor.
I opted for a diversion (which gets the misdemeanor expunged from your record), and completed 1 year of unassisted probation (which ended in January of 2009).
I never went back to court after completing the unassisted probation, and I never had a lawyer throughout this process.

One of my friends had the same thing happen to him, except he had a lawyer. After completing the unassisted probation, the lawyer contacted him and told him that he needed to go back to court to complete the expungement. Apparently, he had a warrant for his arrest between the time he completed his probationary period and the time before his court date.

Now I’m wondering If I have a pending warrant for my arrest, since I never went back to court? If I do, what measures do I need to take to get it removed from my record ASAP? I’m considering driving to the police station this friday and turning myself in. Should I have a lawyer present? How much should I expect to pay in fines?

***I’m going to be traveling internationally in late november, if I don’t get it removed by then I’m afraid that I’ll get detained in an international airport when they try to look up my information from my passport.

***It’s Rutherford county of Tennessee.
