Question by David C: Court Question about underage drinking?
I visited my friend at university of delaware and I drank too much and went to the hospital. I was charged with underage consumption of alcohol. He took a breathalyzer and there is no way I am not guilty, but I am told to plea guilty because I can get probation before judgement. I do not have a criminal record but if I plea not guilty and get probation before judgement does that mean I do not have to go court again. Plus if I plea not guilty that will not insult the judge or cop.

Short answer…if you are charged with any crime more serious than a speeding ticket, get a lawyer.

You will always be pressured to plead guilty…even if you are not guilty! Depending on your circumstances, if you are guilty then a plea might be your best bet…or you might be better off going to trial, even if you are G-U-I-L-T-Y guilty.

Get a lawyer…he’ll tell you what is best for you.

Criminal Background Checks for Ohio Schools? Bus Drivers in Question

Last month, Columbus, Ohio, police arrested an individual who drives bus for one of the Ohio schools in Columbus. The driver was charged with possession of cocaine and further investigation found the individual had three previous convictions for driving under the influence.

First Student, Inc., is the private company, who employs the driver and provides bus drivers for many of the Ohio schools. They employ 22,000 drivers to over 500 school districts in 38 states across the country, transporting nearly two million children each school day. Of the 20,000 bus drivers within the Ohio schools, 3,000-to-5,000 work for private contractors. State law requires that bus drivers for the Ohio schools have a commercial driver’s license and a criminal background check through Ohio’s Bureau of Criminal Identification and Investigation.

After the driver’s arrest, First Student discovered it had not done complete criminal background checks on all of its drivers. Service to the Columbus Ohio schools was suspended and the district cancelled classes for the day to allow the company to review their background check records for other such omissions.

Spokeswoman Jennifer Robinson assured the public that First Student has submitted hundreds of the required background checks and fingerprints to the Bureau since 2004, though Alex Goepfert, spokesman for the state’s attorney general’s office, stated that the firm had not submitted anything since that year. Additionally, she stated that First Student runs all background checks through a private company and believes the arrested driver is an isolated case of omission.

Ed Simpson, chief of policy and administration for the state attorney general’s office, is searching for a better way to improve enforcement of the background check for Ohio schools’ bus drivers law and to ensure such oversight does not occur again.

State attorney general Marc Dann met with Columbus area legislators to discuss ways that the statute can be strengthened. Failure to conduct these criminal background checks is a misdemeanor under the law. According to Simpson, Dann also is investigating if a criminal case or administrative action can be brought against First Student.

First Student’s oversight has other school districts within the Ohio schools asking about their drivers. Robinson stated that First Student is conducting a comprehensive review of all Ohio schools’ bus drivers.

Ohio schools’ Columbus district is evaluating its procedures and whether to cancel their contract with First Student. Ohio schools’ Cincinnati district has asked First Student and their two other private bus driver providers to resubmit their criminal background screenings for further review; they review background checks through the state every two years and locally through a private company every six months. Ohio schools’ Dayton district hires their own drivers and review background checks monthly. According to spokesmen, Ohio schools’ Lorain and Elyria districts were assured by First Student that appropriate checks had been completed on all of their drivers.

QUESTION about getting court records?

Question about caricatures of deceased celebrities?

Let’s say I wanted to make a T-shirt with a caricature of Bea Arthur and sell the T-shirt, with her name on it. Other than helping saturate the lucrative Bea Arthur T-shirt market, does this violate any trademark law by essentially using her likeness for something I would want to make money from, without a representative from her estate granting permission?

Is there a difference if the person is living or dead? I know with music and literature you can record and sell music/books from the so-called public domain. Does this apply with old, dead people, like George Washington?

Wisconsin Child Custody & Support question?

My situation is that I just had a child born on May 9,2009. Now I didn’t think it was my child. So they took me to court and I requested to have a paternity test. The results came back 99.99% so I’m pretty sure she is mine. So since August 14,2009 the day after I received the results was the first time I went to go see her. Now every day I have been going to my child’s mothers house and seen her for about an hour since they won’t let me take her anywhere. And on August 16,2009 they completely blew me off to see my child saying she was at her boyfriends house I could wait to see her and they never even called me back. Now the mother was on Badgercare when she was born. I know I have to pay half of the birthing cost. And the paper work was not filed till June, 15 2009 was wondering what I will be responsible for. And I really want joint custody so I was wondering what rights I have and what I can do. Also I am on felony probation for marijuana charges I am doing beyond well on my probation after I have my community service done, my probation officer is trying to get me off early and my record will be cleared. Not sure if that could do anything. But the mother also had a record, and she has allot of inappropriate things on her myspace not sure if that helps either. Can somebody just help me find someway to get joint custody of my child. No way is it fair to not see her because she wants to see her boyfriend and smoke with the child right in front of them. I also have very high reasons to believe that she smokes marijuana still along with her mother and that is who they both live with. Me and my entire family and girlfriend do not do anything in that matter even drink. So can anyone give me some advice or help in this regard.
For one I am getting of probation and my P.O would give me recommendations and also my charges will be completely cleared no spot on my record at all. Second I wasn’t in my child’s life because there was a lot of reasons to believe that the child was not mine. And the mother has no job and and lives with her mom and they both do drugs and as for the random u.a. I couldn’t care less because I don’t do drugs. So seriously there has got to be more than this that I can do besides sit back and pay child support and not see my child. As for unscheduled visits they are not we have nothing setup and I just call everyday to try and see if I can see her. So there has to be more than this out there.
